Unfortunately I saw this. I don’t think that it was her personal belief. I think that she was doing what lawyers asked her so that the show could avoid a lawsuit. He didn’t plead to “rape” so he’s not a “rapist”. It’s all about avoiding slander and defamation. I personally believe that an adult having sex with a minor is rape–even if he/she consents. The laws have changed since the 60s so it’s possible that today the crime would be classified as rape.

The way I have heard this story, it’s not that the laws haven’t particularly changed, he just more or less plea-bargained to get the deal he got. I can’t imagine that even 30 years ago “drugging and sodomizing a 13-year old” wasn’t RAPE-rape.

Whoopi Goldberg did was to provide the legal context in which the case took place. Roman Polanski was originally charged with with “rape by use of drugs, perversion, sodomy, lewd and lascivious act upon a child under 14, and furnishing a controlled substance (methaqualone) to a minor.” However under a plea bargain those charges were dropped in exchange for pleading guilty to “unlawful sexual intercourse with a minor”.
My mother always told me, if you can’t say something that doesn’t defend the actions of a man who drugged and anally raped a child, don’t say anything at all.
