The dude in this news report is awesome: Kenneth Robinson studied up on a Texas law called “adverse possession,” which allowed him to take over a $330,000 house for just $16 after the house went into foreclosure followed by the
mortgage company going out of business. If he lives in the house for three years, he can become the house’s legal owner — and flip that mutha for a sweet-ass profit.
Meanwhile, the white neighbors who paid full price for their McMansions are NOT happy about it — filing complaints, calling the cops, and looking like whining racist morons on the local news. The whole thing just gives me a rock-hard schadenfröner (I think that’s the term, my German is rusty).
Anyway, I asked Warming Glow’s legal expert Danger Guerrero about this case, and he took a break from studying for the bar exam to direct me to the legal precedent, the landmark case of Haters v. Troll. Man, is Danger gonna CRUSH the bar or what?

I tip my hat to this guy. If I were him, I’d post “mind your own fucking business” signs on my lawn or something saying legal expert on it.
This guy is misstating Texas Law. The 3 year statute was only used in the late 1800′s to clear up title issues from Mexican and Spanish land grants as well as issues with the Patent from the state. To adversely possess in this manner, I believe he would have to meet the 10 year “squatter’s” statute which is Texas Civil Practices and Remedies Code 16.026.
There is no doubt a successor in interest to the assets of the Mortgage Company that went out of business. Whether or not the Foreclosure process has been completed , there is an owner of this property and the suit, called Trespass to Try Title (or they might be able to file under the Declaratory Judgment Act), is not the pain in the ass this newscast makes it out to be.
He is adversely possessing but by drawing all this attention to him, it won’t be for much longer. Love it when news outlets completely misstate the law.

I love that the neighbors’ arguments boil down to, sure, he acted legally, and yes, he’s caused no disruptions in the neighborhood, but come on, his kind just doesn’t belong here.

My first instinct is to high-five this guy and celebrate his good fortune. Then my white cynicism sets in and reminds me you shouldn’t underestimate the resources of wealthy white people in regards to ejecting minorities from their neighborhoods, especially those with dubious legal claims.

Wow, I usually side with the whites. But I’m also not a moron who bought a shitty mini-mansion for 300K. So fuck them. More power to someone who can screw the system like it’s his own personal whore.
While I applaud the guy for jumping on this house, you can’t say it doesn’t affect the other homeowners at ALL – property values are all based on what other property in the area sells for, aren’t they? So woudln’t his grabbing this house for a song adversely affect their houses’ worth?
